Product liability laws are designed to ensure fair competition and the free flow of truthful information in the marketplace. These laws, also known as consumer protection laws are a form of government regulation which protects the interests of consumers. For example, a government may require businesses to disclose detailed information about products; particularly in areas where safety or public health is an issue, such as food. The American Legislative Exchange Council (ALEC) explains the Product Liability Act in more detail. Product liability laws require that consumers receive important information about companies and the products and services they offer, so consumers can make well-informed buying decisions.

Product Defects

Product defects are a serious concern for all manufacturers and are typically covered or addressed in the product warrantee. However, if a product or a part of a product fails and/or is dangerous, the resulting injuries are subject to fair compensation from the manufacturer of that product or part. Some common product defects are often involved in product recalls and include tires, brakes, gas pedals, baby crib slats, and electric malfunctions. There is some overlap with product liability laws and personal injury, and personal injury lawsuits can result from auto accidents, medical malpractice, and defective products.

Product liability legal services can cover a wide array of issues and in order for the injured party to obtain the fairest compensation possible it is in their best interest to work with an experienced attorney. Many product liability and personal injury issues have time limits in which to file lawsuits, which experienced lawyers are familiar with. Product liability laws can vary from state to state, so it is imperative that your lawyer have thorough knowledge of the specific product liability laws in your state.
